Five Reasons Bankruptcies Are Filed

Posted by admin in Credit Matters, Finance Network

People file bankruptcy for numerous different reasons. Very few individuals file bankruptcy when they can pay their bills. The bankruptcy changes made in 2005 prevent this from occurring. These are the five biggest reasons people think about filing bankruptcy:

Medical Bills
An accident or medical illness can impact family finances quickly. When someone has no health insurance, the risk is even higher. Add in the fact that an illness means one earning family member or more can miss work, and income is drastically diminished. Which takes us to the next popular reason people file bankruptcy.

Job Loss
Job loss and layoffs can place people in a financial catastrophe quickly, particularly if they were living paycheck to paycheck while employed. Unemployment benefits don’t compare to previous earnings and only last a set amount of time.

Stop Foreclosure
Stopping a foreclosure can often only be done by filing a chapter 13 bankruptcy. Filers can include overdue mortgage payments and legal fees into the bankruptcy repayment plan, permitting filers to keep their home and create a workable payment plan.

Stop Wage Garnishments and Repossessions
By filing a ch 7 bankruptcy, wage garnishments can be halted. If your car or other property is at risk of being repossessed, including the overdue payments in a ch 13 can stop repossessions and even get your property returned after repossession if filed in time.

Stop Creditor Harassment
A “bankruptcy stay” is entered when you file, making it against the law for creditors to contact you. Creditor calls and mail will stop once you file, allowing you to relax and get back on your feet.

Filing bankruptcy no longer has the stigma typically associated with it in the past. And with unemployment rates at over 10%, more people will be taking advantage of the relief bankruptcy provides.
