He was also required to pay the locum. This unfettered right had never been used by the dentist though fellow dentists under similar contract terms had relied on this provision on prior occasions.
The Employment Tribunal ruled that Dr Sultan-Darmon had been provided with an unfettered right to appoint a substitute dentist. He was not under compulsion to provide his services to the Centre and therefore cannot be considered a ‘worker’ of the organization.
