An employee’s death at workplace caused the operations director of a pet food company to be penalised for his failure to provide adequate safety measures to workers. The director was held personally responsible for the tragedy.
The accident occurred at the factory of Butcher’s Pet Care Ltd. when employee John O’Connor was using a palletising machine. The machine takes cans from the conveyor belt and arranges them into stacks on pallets. O’Connor was killed when he stepped into the palletising equipment to clear a blockage there. He entered the machine using a gap in the stair rails that had not been fenced off. When he cleared the block, the machine started moving and it dragged him inside the moving parts, killing him instantly.
The machine is designed to function automatically on sensors without any human intervention. It should ideally have been secured so that no one could enter it while it was running on power. However, the employees of the company were in the habit of walking in and out of the machine when blockages occurred by using the stair rail gap, which had not been filled in.
The operations director of the company, Philip Thompson, was charged with breaching Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998. He was asked to pay a fine of 10,000 pounds and additional costs of 4,000 pounds after he accepted liability for negligence that led to the incident. The hearing was held at Northampton Crown Court.
Speaking about the incident, HSE Principal Inspector for Northamptonshire Neil Craig said that had the director fulfilled his obligations to ensure safe working conditions for the employees of the company, such an accident would never have happened.
