Contract Employees should Understand their Employment Status Clearly


The Employment Appeal Tribunal has ruled in favor of a dental service after a contract employee of the centre filed a case of unlawful salary deductions claim. The case shows that that an unregulated right of substitution in contract jobs can affect worker status.

Dr Sultan-Darmon was hired to provide dental services with Community Dental Centres (the Centre) strictly as a contract worker. Both parties were aware of the fact that the dentist was not working in the capacity of an ‘employee’. But Dr Sultan-Darmon’s argument was that as he was a ‘worker’, he was entitled to file a case of unlawful wage deductions against the Centre. The Centre argued that the dentist was a self-employed sub-contractor.

According to his employment contract, he had a “licence agreement and contract for service” with the Centre, which meant that the dentist’s status was that of a self employed independent contractor. As per the terms of the contract, he had to make alternate arrangements for a locum to provide dental services in his leave of absence (barring permitted holidays). He was also required to pay the locum. This unfettered right had never been used by the dentist though fellow dentists under similar contract terms had relied on this provision on prior occasions.

The Employment Tribunal ruled that Dr Sultan-Darmon had been provided with an unfettered right to appoint a substitute dentist. He was not under compulsion to provide his services to the Centre and therefore cannot be considered a ‘worker’ of the organization. Following the ruling, law firm Blake Lapthorn commented that the court’s ruling are relevant to contract employees in the construction sector.
